These Terms set out the rules for using the maryjane.farm website (the “Service”). By using the Service, the User accepts these Terms.

1. Definitions

  • Service – the website available at maryjane.farm.
  • User – any person visiting the Service.
  • Comment – content added by a User under articles.
  • Newsletter – email messages sent to Users who have consented to receive them.
  • Controller – the entity operating the Service Maryjane.farm

2. Nature and purpose of the Service

  1. The Service is educational and informational in nature and concerns the cultivation of cannabis/marijuana in a theoretical, hobbyist and harm‑reduction context.
  2. The content in the Service does not constitute legal advice nor an encouragement to break the law. The User is responsible for knowing and complying with the laws applicable in their jurisdiction.
  3. The Service does not sell products or services that would be contrary to applicable law.

3. Age requirements and legal compliance

  1. The Service is intended for adults and for persons for whom access to such content is permitted by the laws of their country/place of residence.
  2. If the applicable law prohibits access to certain content, the User should cease using the Service.

4. Technical requirements

To use the Service, you need a device with Internet access, an up‑to‑date web browser and an active email address (for the newsletter/comments). It is recommended to enable cookies and JavaScript.

5. Rules of use

  1. The User undertakes to use the Service in a manner consistent with the law, these Terms and good practice, with respect for the rights of others.
  2. It is prohibited to provide unlawful content, including:
    • content that violates the law (e.g. incitement to commit an offence, instructions on how to circumvent the law),
    • content that infringes copyrights, personal rights or principles of social coexistence,
    • vulgar, offensive, discriminatory content, hate speech, spam, advertising without the Controller’s consent.
  3. The Controller may temporarily restrict access to the Service (e.g. maintenance breaks) or remove content that violates these Terms.

6. Comments and User Materials (photos/works)

  1. The User may add comments and submit their own User Materials, in particular photos of plants or crops, graphics and descriptions. The email address provided with a comment is used solely for verification and is not published.
  2. The User declares that they have all rights to the User Materials and that these materials do not infringe the rights of third parties; if images of persons are recorded, the User has the appropriate permissions to disseminate such images.
  3. By submitting User Materials to the Service, the User grants the Controller a non‑exclusive, royalty‑free, territory‑unlimited licence to use the User Materials in the following fields of use:
    a) fixation and reproduction by any technique;
    b) inclusion in computer memory, information networks and databases;
    c) making available to the public in such a way that anyone can access them at a place and time of their choosing (in particular in the Service, the newsletter and the Controller’s social media);
    d) public display, performance, broadcasting and rebroadcasting;
    e) adaptation to the necessary extent (cropping, compression, thumbnails, colour correction, transcoding, adding an editorial caption), combining with other content of the Service;
    f) use in materials promoting the Service and its content (article teasers, illustrative graphics, newsletters, social media posts), with the author’s name/pseudonym indicated if provided.
  4. The licence referred to above is granted for the period of publication of the User Material in the Service and – with respect to: (I) materials already disseminated (e.g. archived newsletters, published social media posts), (II) evidentiary, accounting and archiving purposes – for the period necessary to protect claims.
  5. The User may request deletion of the User Material or withdrawal of the licence with effect for the future by contacting the Controller. Withdrawal does not affect the lawfulness of use that occurred before the withdrawal.
  6. The Controller may refuse publication, edit a description or remove User Materials that violate the law, these Terms, the Privacy Policy or the subject matter of the Service.
  7. It is prohibited to submit User Materials containing personal data or images of third parties without their consent, information enabling identification of the cultivation location (e.g. GPS coordinates in metadata), content that is unlawful or that provides instructions on how to circumvent the law.
  8. To the extent that a User Material constitutes a work within the meaning of copyright law, the User authorises the Controller to exercise derivative rights (to make adaptations) to the extent necessary for technical and promotional purposes.
  9. The User is responsible for the User Materials and agrees to hold the Controller harmless against claims by third parties arising from the publication of the User Materials, where such claims result from the User’s lack of rights or permissions.

7. Newsletter

  1. Subscribing to the newsletter requires the User’s consent (double opt‑in).
  2. The User may unsubscribe at any time via the unsubscribe link in the footer of the message.
  3. Detailed rules for processing data in the newsletter are set out in the Privacy Policy.

8. Intellectual property

  1. The content published in the Service (texts, graphics, website layout) constitutes works within the meaning of copyright law and is protected.
  2. Without the Controller’s written consent, it is prohibited to copy, distribute, translate or otherwise use such content beyond permitted use.
  3. The above provisions do not limit the licence granted to the Controller by Users for User Materials in accordance with Section 6 of these Terms.

9. Liability

  1. The Service is informational and educational in nature. The Controller is not liable for the User’s use of the information in a manner that is unlawful or constitutes a breach of the laws of the User’s jurisdiction.
  2. The Controller uses due care to ensure that the content is up‑to‑date and reliable, but does not guarantee its complete accuracy or completeness, nor uninterrupted availability of the Service.

10. Notice & Takedown procedure

  1. If a User believes that content published in the Service violates their rights or the law, they should promptly contact the Controller (email: info [at] maryjane.farm), indicating:
    • identifying information about the notifier,
    • the URL address and a description of the challenged content,
    • justification of the infringement and the request (e.g. removal or blocking of access).
  2. The Controller will consider the notice within a reasonable time and take appropriate action.

11. Complaints

  1. Complaints regarding the operation of the Service may be submitted by email: info [at] maryjane.farm.
  2. The notice should describe the problem and include contact details. A reply will be provided within a reasonable time (no longer than 30 days).

12. Amendments to the Terms

The Controller may amend these Terms for valid reasons (e.g. changes in law, functionality, tools). We will inform about amendments by publishing a new version in the Service. Amendments apply from the date of publication unless stated otherwise.

13. Governing law and jurisdiction

These Terms are governed by the law of Germany. Any disputes will be resolved by the court having local jurisdiction over the Controller’s registered office, unless mandatory provisions of law provide otherwise (e.g. in relations with consumers).
